Aboriginal Rights and
Aboriginal Relations

The Report of the Aboriginal Justice Inquiry contains both a detailed examination of the experience of Aboriginal people with the Canadian criminal justice system, and a broader discussion of the relations between Aboriginal and non-Aboriginal people in Manitoba and Canada. Its examination of the rights of Aboriginal people, both in treaty and common law, and its review of the historical experience of Aboriginal people with the Canadian justice system, led the AJI to recommend the establishment of an Aboriginal justice system and the recognition and fulfillment of unmet treaty and Aboriginal rights. The following three chapters of this report deal with the AJI recommendations in this area. The AJIC gives priority to measures that:

  • fulfill land-entitlement obligations

  • fulfill Northern Flood Agreement Obligations

  • fulfill obligations to Métis people

  • approach Aboriginal issues in a manner that leads to a recognition and fulfillment of Aboriginal rights, and to reconciliation between Aboriginal people and other Canadians

  • improve the justice system while assisting Aboriginal people and communities to undertake measures that can lead to the implementation of their constitutional and other legal rights
